General Terms and Conditions (GTC)

1. Scope

(1) These General Terms and Conditions (GTC) apply to all contracts between Decoria, owner Mustafa Kerim Pistofoglu (hereinafter "Decoria"), and its customers.

(2) These GTC apply to both consumers (§ 13 BGB) and entrepreneurs (§ 14 BGB), unless individual provisions stipulate otherwise.

(3) Deviating or conflicting business conditions of the customer shall only become part of the contract if Decoria expressly agrees to their validity in writing.


2. Conclusion of Contract

(1) Offers from Decoria are non-binding and subject to change, unless expressly designated as binding.

(2) A contract is only concluded upon written order confirmation, commencement of the performance of services, or delivery of goods.

(3) Amendments or additions to the contract require text form (e.g., e-mail), unless otherwise prescribed by law.


3. Prices and Payment Terms

(1) The prices agreed upon in the offer apply.

(2) All prices are in Euro.

(3) Unless otherwise agreed, invoices are payable without deduction within 14 days of the invoice date.

(4) If the customer is in default of payment, Decoria is entitled to claim default interest in accordance with statutory provisions as well as further damages caused by default.

(5) The customer is only entitled to offsetting or retention rights if their counterclaims have been legally established or are undisputed.


4. Services, Deadlines, and Execution

(1) The type and scope of services result from the respective offer or order confirmation.

(2) Stated delivery or completion dates are only binding if they have been expressly agreed upon as binding.

(3) Delays in delivery or performance due to force majeure or other unforeseeable events for which Decoria is not responsible (e.g., material shortages, strikes, natural events, or official measures) shall extend agreed deadlines appropriately.

(4) The customer must ensure that the work areas are freely accessible and suitable for the execution of the work at the agreed date.


5. Customer's Cooperation Obligations

The customer must provide all necessary information in a timely manner and obtain necessary permits, unless these are expressly undertaken by Decoria.

If delays arise due to a lack of cooperation from the customer, any resulting additional costs may be charged separately.


6. Acceptance

If acceptance is legally or contractually provided for, the customer must accept the service immediately after completion.

Acceptance may only be refused due to significant defects.


7. Warranty

(1) The statutory defect rights apply.

(2) Obvious defects must be reported to Decoria immediately after discovery.

(3) Decoria is initially entitled to supplementary performance.


8. Liability

(1) Decoria is liable without limitation for damages resulting from injury to life, body, or health, as well as for damages based on intent or gross negligence.

(2) In the event of slight negligence in the breach of essential contractual obligations, Decoria is only liable for the contract-typical, foreseeable damage.

(3) In all other respects, liability is excluded to the extent permitted by law.

(4) The provisions of the Product Liability Act remain unaffected.


9. Retention of Title

Delivered goods remain the property of Decoria until full payment of all claims arising from the business relationship.


10. Data Protection

Personal data will be processed exclusively in accordance with applicable data protection regulations.

11. Place of Jurisdiction and Applicable Law

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

(2) If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is the registered office of Decoria.


12. Final Provisions

Should individual provisions of these GTC be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.

The statutory provision shall replace the invalid provision.
